Amendment to the Hazardous Products Regulations
This post is to notify you that an amendment to the Hazardous Products Regulations (HPR) was recently approved by the Governor in Council and registered by the Clerk of the Privy Council on April 4, 2018. The final regulatory text will be published in the Canada Gazette, Part II on April 18, 2018.
This amendment to the HPR is effective immediately, and an administrative version of the final regulatory amendment and the Regulatory Impact Analysis Statement (RIAS) have been attached for information pending the publication of the amendment and the RIAS in the Canada Gazette, Part II. These are pre-release drafts; however, they are the same as the versions to be published. The amendment, which was initially proposed and published in the Canada Gazette, Part I on October 21, 2017, allows for the use of prescribed concentration ranges to protect the trade secret concentrations and concentration ranges of materials or substances in hazardous products. One change was made to the amendment proposed in October, which is to allow the combination of only 2 prescribed consecutive concentration ranges set out in paragraphs 4.5(3)(a) and (g) of the HPR. Further information relating to this change is provided in the attached RIAS.
Further, acknowledging that many claims for exemption relating exclusively to ingredient concentrations or concentration ranges have already been filed under WHMIS 2015, Health Canada will contact impacted claimants over the coming months to discuss options for those claims.
